Procedure Process

Eligibility:

  • He has a well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion; if he is outside his country of nationality; and, if owing to such fear, he is unable or unwilling to avail himself of the protection of his country; or
  • If you come from a country where there is foreign aggression, occupation, foreign domination or events seriously disturbing public order and you are forced to leave it to seek refuge elsewhere outside that country.

Who can apply


A person may apply for refugee status if:

 

  1. Any person who is in Belize and wishes to remain in Belize as a refugee under the terms of the Belize Refugees Act Chapter 165 of the Substantive Laws of Belize, Revised Edition 2011. 
  2. It is not possible to apply for asylum outside of Belize.  If you are outside Belize, you can apply for asylum at the Belize border - and you must be referred to the Refugee Department in Belmopan. According to the Refugee Act, you can apply for asylum regardless of whether you have a passport or not.
  3. Once in Belize, an asylum application must be filed promptly with the Refugee Department in Belmopan within fourteen (14) days of entering the country.
  4. Your application should include your personal and household details, a detailed statement of the reasons for seeking asylum, and contact details in Belize, among other information.
  5. The process is confidential and free of charge with no intermediaries.
  6. For minors under 18 years of age without family members in Belize, the Refugee Department will contact the Department of Human Services who can place them in a home or center. Any minor who is fearful of returning to his or her home country and wishes to apply for asylum should inform the assigned social worker.
  7. While awaiting a final decision on your asylum application, you will not be authorized to work legally.

Application:


A person who wishes to apply for refugee status must apply in person at the Refugee Department.


1) He/she must fill out a form with all the information requested therein.
2) He/she must present documents of him/herself and his/her family members:

  • Identity document (passport, nationality identification document, other photo identification document).
  • Birth certificate.
  • Evidence in support of your application for refugee status.
  • If you are with family members you must provide the same requirements for each person.

Where to apply

 

  • A person wishing to apply for refugee status must be in Belize and may apply directly to the Refugee Department in Belmopan to an immigration officer at any point of entry or other location in Belize, who will refer you to the Refugee Department.
  • You may apply to a police officer at a checkpoint or other location in Belize, who will refer you to the Refugee Department.- After submitting the documentation, you and each member of your family will be issued a provisional document that will accredit you as an asylum seeker and provide you with a temporary regular stay in the country. During the asylum process, the applicant must return periodically (every three (3) months) to the Refugee Department in Belmopan to obtain extensions of the temporary stay document. With this document, you will be able to transit freely through the country.
  •  Appeal in case of a negative decision:

- If you receive a negative response stating that your case does not qualify for refugee status, under the rules of the Refugee Act, Chapter 165, section 8(5) you may file an appeal in writing to the Minister of Immigration within fourteen (14) days after being notified of such negative decision.

- The minister will review the case and make a final decision. In the event that the negative decision is final, you may inquire about the possibility of later regularizing with the Immigration Department in another immigration status. If you do not have any other immigration options, you may be deported to your country of origin.
