Guatemalan legislation does not contemplate humanitarian visas; however, it does contemplate entry for humanitarian reasons.
Entry of persons for humanitarian reasons Article 68.
- For natural catastrophe in neighboring countries, which forces persons or group of persons to save their lives.
- People to save their lives.
- For medical emergencies or to save the lives of persons, aircraft or maritime vessels.
- For reasons of armed conflict, in accordance with international law.
- By request for cooperation of another State or bodies created by international law to enter equipment, ships, aircraft or.
- International to enter equipment, vessels or persons whose purpose is medical, aid or relief.
- For repatriation of remains of family members who died in Guatemala.
- The permanence of these persons or vessels shall be governed in accordance with the provisions of this code and its regulations.
- If the person manifests to be persecuted in his country of origin, to be a victim of threats of violence or to be a victim of violence, requires application for recognition of refugee status or territorial political asylum, entry for humanitarian reasons, the person will have available shelter and temporary care.
- In the case of a child or adolescent, they shall be cared for in accordance with the legal provisions in force and the provisions of this Code.
- If they are migrant women who declare that they are victims of sexual violence or are being persecuted for such purposes, or victims of domestic violence, they shall be granted health assistance and shall proceed in accordance with the provisions of the specific law. The right not to be returned to the country of origin or origin shall prevail if there is a serious threat of being a victim of sexual violence in any form.
- If it is a family, the provisions of this Code shall apply and it shall be the deputy director of Attention and Protection of Fundamental Rights of Migrants who must provide attention and follow-up to the case for family reunification, protection and assistance to children or adolescents in accordance with their best interests, or in accordance with the principles governing the action as appropriate.
Article 85. Stay status for humanitarian reasons
When foreign persons enter Guatemala for the reasons defined in article 68 of the present Code, they shall be granted the status of permanence for proven humanitarian reasons.
- In this regard, persons must be identified by means of special tickets that must be carried at all times and which must contain personal identification data, if they have entered accompanied by their family or any blood relative, the reasons that grant the status, the signature and seal of the deputy director for the Attention, Assistance and Protection of Fundamental Rights of Migrants and the general director of the Guatemalan Institute of Migration.
- The deputy director of Attention and Protection of Fundamental Rights of Migrants shall keep a single and updated record with the information of all persons who have been granted this status.
Article 89. Migratory impediments of egress
They can not leave the country:
- Unaccompanied children and adolescents who do not carry the official documentation required to be able to travel alone or in the company of persons who are not legally authorized.
- Persons who, being under request of refugee status, political asylum or status of permanence for humanitarian reasons, have not made the notices and justifications required by the Guatemalan Institute of Migration.
- Persons who by court order are not allowed to leave the country.
- The Guatemalan Institute of Immigration shall issue the necessary provisions on the official documents that must be carried, also, on coordination with the tax authorities, administrators of seaports, airports and others that are required for effective compliance and control of the rules of impediment of exit from the country.
Article 104. Travel document for asylum seekers or refugees, refuge or for humanitarian reasons
Persons recognized as refugees or asylees who do not have travel documents may request the Guatemalan Institute of Migration to issue a special travel document consisting of a document under the characteristics set forth in the article that refers to the Special Travel Document of this Code. This Special Travel Document will be valid for one entry and one exit.
